Terms of service
Effective date: October 19, 2026
These Terms govern the Snowpack application, website and related services provided by Patrick Dayton, operating as Snowpack ("Snowpack", "we", "us"). Please read them with the Privacy Policy and End User License Agreement. You must agree to these Terms to use account-based services. If you do not agree, do not use those services. Section 10 contains a binding arbitration agreement, subject to the exceptions stated there.

1. Eligibility and accounts
You must be at least 13 to use Snowpack. We do not add a separate parental-permission requirement for riders aged 13–17, but applicable local age, capacity and parental-consent requirements still apply. Availability can depend on platform distribution rules, local law and sanctions.
Provide accurate account information, protect your credentials and contact support if you suspect unauthorized use. You are responsible for your own activity to the extent permitted by law. Account email and private profile information are handled under the Privacy Policy.
2. Free access
Snowpack is free. There are no paid plans, subscriptions, in-app service charges or advertisements. Your carrier or internet provider may charge for connectivity. Resort access, equipment and other third-party services are separate.
Any future pricing change would require advance disclosure and any legally required consent. These Terms do not authorize automatic future billing.
3. Mountain conditions and personal responsibility
Skiing, snowboarding and mountain travel involve serious risks. Weather, terrain access, operations and avalanche hazards can change quickly. Forecasts, maps, statistics and community reports may be incomplete, inaccurate or delayed.
Use your judgment and follow resort rules, closures, official forecasts, avalanche bulletins and local guidance. Snowpack does not provide professional guiding, rescue, avalanche forecasting or a guarantee that terrain is safe. Off Piste travel requires appropriate skills, equipment and planning.
4. Sessions and location sharing
Sessions help joined riders share positions and arrange meetings while keeping independent recordings. An invitation alone does not share location. Joined riders may include friends invited by others. You control your sharing; GPS, reception, battery and offline retries can delay position updates or stopping remote sharing.
Snowpack does not monitor sessions for emergencies or automatically dispatch help. Do not rely on it as your only means of communication or navigation. Contact local emergency services when needed.
5. Acceptable use and reports
Use Snowpack lawfully and respectfully. Do not threaten, harass, impersonate, expose another person’s private information, post unlawful or exploitative material, infringe others’ rights, encourage entry into closed terrain, manipulate statistics, distribute malicious code, bypass access controls or collect other riders’ information without authorization.
Use reporting and blocking controls where available, or email patrick.dayton12@gmail.com with the content or account involved and your concern. Patrick Dayton personally reviews reports. Content can publish before review; we do not promise continuous monitoring or a fixed moderation response time. For imminent danger, contact emergency services.
6. Your content and sharing
You retain ownership of your content. You grant Snowpack a non-exclusive, worldwide, royalty-free license to host, store, reproduce, technically format, transmit and display it only as needed to operate, secure and support Snowpack according to the relevant sharing settings. Necessary service providers may perform those functions for us. This does not authorize unrelated advertising or business use.
You must have the rights and permissions required for material you submit. Public content and shared routes can reveal your location. New community profiles have resort-session sharing on by default; enabling it can publish eligible past synced recordings as well as future ones. See the Privacy Policy for audiences and controls.
The operational license ends when the content is deleted from our active systems, except for limited processing needed to remove it from backups, resolve a legal obligation or preserve evidence of a specific dispute. Account deletion includes all account-owned content under the Privacy Policy; copies other people have made are outside our control.
7. Moderation, suspension and ending use
We may remove content or restrict an account for violations, security risks, threats to safety or legal requirements. We may act immediately for serious abuse, safety threats or security risks. Otherwise, we provide notice and an opportunity to resolve the issue where reasonable and legally required.
To appeal, email patrick.dayton12@gmail.com with “Account appeal,” your account identifier and why you believe the decision should change. Patrick Dayton personally reviews appeals and will explain the outcome, except where disclosure is legally restricted or would undermine security.
You can stop using Snowpack at any time. Request account deletion at the same email address. Our initial response target is 7 calendar days; our active-system deletion target is 14 calendar days after verification. Deletion includes your profile, recordings, posts, comments and photos, subject to limited legal, security and backup exceptions described in the Privacy Policy. Suspension is separate from account deletion.
8. Third-party services and intellectual property
Maps, weather, sign-in, app distribution and other services may be supplied by third parties under their own terms. We do not guarantee their availability or data. Snowpack’s software, branding and original materials belong to us or our licensors. The EULA explains your permission to use the app.
9. Availability, warranties and liability
To the extent permitted by law, Snowpack is provided “as is” and “as available,” without promises of uninterrupted operation, accurate forecasts or particular results. We may change or discontinue features subject to applicable notice requirements and consumer rights.
To the extent permitted by law, we are not liable for indirect or consequential losses arising from use of the service. Nothing excludes or limits liability for fraud, intentional misconduct, gross negligence, death or personal injury caused by negligence, or any other liability or consumer right that applicable law does not allow us to exclude or limit. Where a disclaimer is prohibited, the applicable statutory protection controls.
10. Governing law and arbitration
These Terms are governed by the laws of Texas, United States, subject to mandatory protections where you live. Please contact patrick.dayton12@gmail.com first to try to resolve a dispute.
Except for eligible small-claims cases and claims that cannot legally be arbitrated, you and Patrick Dayton, operating as Snowpack agree to resolve disputes arising from Snowpack or these Terms through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules and consumer fee schedule. Hearing arrangements and fees follow those rules. If AAA declines or is unable to administer a dispute, either party may bring it in court.
Court proceedings related to these Terms will take place in the state or federal courts serving Tarrant County, Texas, unless mandatory law permits another forum. Nothing in this section limits non-waivable consumer rights.
11. Updates and contact
We will update the effective date when these Terms change. For a material change, we will provide an in-app notice or another direct notice before it takes effect where required. We will obtain affirmative agreement when required by law; merely publishing revised terms does not replace that requirement. If you do not accept a change, you may stop using Snowpack and request account deletion. Changes do not retroactively remove accrued rights.
If a provision is unenforceable, the remaining provisions continue to apply to the extent legally permitted. Failure to enforce a provision on one occasion is not a general waiver.
