End user license agreement
Effective date: October 19, 2026
This End User License Agreement ("Agreement") is between you and Patrick Dayton, operating as Snowpack ("Licensor") for the Snowpack mobile application and its updates. Snowpack is licensed, not sold. Please read this Agreement before installing or using the app. Service use is also governed by the Terms of Service; information practices are described in the Privacy Policy.
On this page
1. License grant
Subject to this Agreement, Licensor grants a limited, non-exclusive, non-transferable license for personal use on compatible devices you own or control. On Apple platforms, this covers Apple-branded products and is subject to Apple Media Services Usage Rules, including permitted Family Sharing or volume purchasing access.
2. Free application
Snowpack is free, with no paid plans, subscriptions or advertisements. This license requires no payment and authorizes no future billing. Connectivity, resort access and equipment costs are your responsibility.
3. License restrictions
You may not resell, rent, sublicense, distribute or make the app available as a shared service except as permitted by store rules or law. Do not reverse engineer, decompile, create derivative works, bypass security or remove proprietary notices except where applicable law gives you a non-waivable right. Do not use the app unlawfully.
4. Updates, maintenance and support
Updates are delivered through the applicable distribution platform, including the App Store when available. Your device’s update settings apply. Updates may be necessary for security or compatibility and can change functionality. Material changes receive notice as described in the Terms of Service and as required by law. No fixed update schedule is promised.
Licensor provides maintenance and support required by this Agreement or law; Apple has no maintenance or support obligation. Contact patrick.dayton12@gmail.com or 858-952-6344. Developer details appear in Section 12.
5. Data and connected features
Accounts, recordings, maps, forecasts, notifications and shared sessions process information as described in the Privacy Policy. Device permissions and sharing controls apply. Optional usage analytics can be declined. Some features require connectivity, an account or third-party services.
6. Mountain use
Snowpack is a recreational companion, not an emergency, rescue, avalanche-detection or professional navigation service. Forecasts, maps, statistics and shared positions can be inaccurate, delayed or unavailable. You remain responsible for your equipment, decisions, terrain access and compliance with official guidance.
7. Warranty and product claims
To the extent law permits, the app is provided “as is” and “as available.” Mandatory warranties and consumer rights remain protected. Licensor handles product liability, legal compliance, privacy and consumer-protection claims concerning the app.
For failure to meet an applicable warranty, you may notify Apple, which will refund any applicable purchase price under its rules; Snowpack is free. To the lawful maximum, Apple has no further warranty responsibility. Other required remedies and warranty-related claims are Licensor’s responsibility.
8. Intellectual property claims
Licensor and its licensors own the app’s intellectual property. Licensor, rather than Apple, is responsible for investigating, defending, settling and discharging third-party claims that the app or your permitted use infringes intellectual property rights.
9. Liability and termination
The limitations and statutory protections in Section 9 of the Terms of Service also apply to this license. They do not limit any liability or remedy that law does not permit us to restrict.
The license continues until terminated. You may end it by stopping use and deleting the app. Licensor may terminate for material breach, with legally required notice and opportunity to remedy, or act immediately for serious abuse, safety threats or security risks. Appeals follow the Terms of Service. Uninstalling does not delete cloud data; request account deletion as described in the Privacy Policy. Accrued rights and provisions needed to resolve an existing dispute survive termination.
10. Legal compliance and third-party terms
You represent that you are not in a country subject to a U.S. government embargo or designated by it as supporting terrorism, and are not on a U.S. prohibited or restricted-party list. You must comply with applicable export controls, sanctions and third-party terms, including wireless, map and platform agreements. Availability is subject to those restrictions.
11. Apple acknowledgement
This custom Agreement is between you and Licensor, not Apple. Licensor is responsible for the app and its content. Apple and its subsidiaries are third-party beneficiaries entitled to enforce this Agreement upon your acceptance. Nothing here authorizes use contrary to applicable Apple Media Services Usage Rules.
12. Governing law and developer contact
This Agreement is governed by Texas, United States, subject to mandatory local consumer protections. Disputes follow the arbitration and court provisions in Section 10 of the Terms of Service, including the small-claims exception and non-waivable rights.
